Buying A House | Employing a Solicitor
If and when you do decide to buy a house, it is strongly advised that you get your solicitor involved in the process as soon as you pay your booking deposit. A booking deposit is refundable, so at this stage if the deal does not go through for some reason you will not lose your money but you may lose your dream home, obtaining the services of a solicitor as early as possible may prevent this.
You should then provide your solicitor's details to both the mortgage company and the estate agent/ auctioneers acting for the vendor (the current owner of the house). The mortgage lender will forward your solicitor a second copy of the loan offer, which you should read through carefully with the aid of your solicitor before signing it and returning it to the mortgage company.
The estate agent or auctioneer will also send your solicitor's details to the solicitor acting for the vendor. A contract for sale will then be passed from the house owner's solicitor to your solicitor and with this contract for sale should be a copy of the title documents of the property for sale.
If you are buying a brand new home, the builder's solicitor will send your solicitor a copy of the plan, specifications and also a building agreement. It is then the job of your solicitor to check that the title to the property is legally in order.
